PARKING TERMS & CONDITIONS
Parking Compliance Services Ltd (PCS Ltd)
1. Purpose of These Terms
1.1 These Terms & Conditions regulate the use of all parking locations managed, operated, or enforced by Parking Compliance Services Ltd (“PCS Ltd”).
1.2 They define:
• The contractual relationship between PCS Ltd and Drivers
• The circumstances under which Parking Charges are issued
• The rights and obligations of Drivers and Keepers
• The enforcement and recovery process
1.3 These Terms are designed to comply fully with:
• The Private Parking Sector Single Code of Practice
• The Protection of Freedoms Act 2012
• The Consumer Rights Act 2015
• The UK GDPR and Data Protection Act 2018
2. Definitions and Interpretation
2.1 “Driver” means the individual who parked or was in control of the Vehicle.
2.2 “Registered Keeper” or “Keeper” means the person recorded by the DVLA as responsible for the Vehicle.
2.3 “Vehicle” includes cars, vans, motorcycles, and any other motorised vehicle.
2.4 “Site” means any land, car park, or area where PCS Ltd provides parking management or enforcement.
2.5 “Signage” means all signs displayed at the Site, including entrance signs and terms signs.
2.6 “Parking Session” means the period during which a Vehicle is parked on the Site.
2.7 “Parking Charge” means the contractual charge payable for breach of these Terms.
2.8 “PCN” means Parking Charge Notice.
2.9 Words importing the singular include the plural and vice versa.
3. Formation of the Parking Contract
3.1 By entering, stopping, waiting, or parking on the Site, the Driver enters into a legally binding contract with PCS Ltd.
3.2 The contract is formed by:
• The presence of prominent Signage
• The Driver’s decision to remain on the Site
3.3 The Driver confirms they have:
• Read the Signage
• Understood the Terms
• Accepted the Terms
3.4 No written or verbal agreement is required.
4. Authority to Enforce
4.1 PCS Ltd operates under written authority from the landowner or lawful occupier.
4.2 This authority includes the right to:
• Control parking
• Issue PCNs
• Obtain Keeper data from the DVLA
• Recover unpaid Parking Charges
• Conduct legal proceedings in PCS Ltd’s own name
5. Conditions of Parking
Drivers must comply with all conditions stated on Signage, including but not limited to:
• Payment of the correct tariff
• Correct entry of the vehicle registration number
• Parking wholly within marked bays
• Displaying permits or tickets when required
• Observing maximum stay limits
• Parking only in authorised areas
Failure to comply constitutes a breach of contract.
6. Payment Systems and Driver Responsibility
6.1 Payment may be required via:
• Pay and display machines
• Pay by phone systems
• Mobile applications
• Permit systems
6.2 Drivers are responsible for:
• Using payment systems correctly
• Ensuring payment covers the full duration
• Ensuring accurate vehicle details are entered
6.3 Errors, omissions, or assumptions by the Driver do not invalidate the contract.
7. Unpaid, Underpaid, or Invalid Parking
7.1 A breach occurs where the Driver:
• Fails to make payment
• Makes insufficient payment
• Overstays a paid session
• Inputs incorrect registration details
• Uses an invalid permit
• Parks contrary to restrictions
7.2 In such cases, a Parking Charge becomes payable.
8. Nature of the Parking Charge
8.1 The Parking Charge is a contractual sum agreed upon parking.
8.2 It is not:
• A penalty
• A fine
• A parking tariff
• Damages for loss
8.3 The Parking Charge is payable regardless of the tariff that would otherwise have been due.
9. Parking Charge Amounts
9.1 Parking Charges are capped in accordance with the Single Code.
9.2 The maximum Parking Charge will not exceed:
• £100, or
• £60 if paid within the applicable discounted period
9.3 No additional sums will be added unless permitted by law.
10. Parking Charges and Unpaid Parking Tariffs
10.1 Where a Driver parks on the Site without making payment, makes insufficient payment, or otherwise fails to pay the applicable parking tariff, this may give rise to:
• (a) the issue of a Parking Charge Notice (PCN) for breach of these Terms & Conditions; and
• (b) the existence of an unpaid parking tariff, representing the fee that would have been due had the parking terms been complied with.
10.2 The Parking Charge is a contractual charge arising from breach of contract and is subject to the applicable caps and requirements set out in the Private Parking Sector Single Code of Practice.
10.3 As a general principle, PCS Ltd does not seek to recover unpaid parking tariffs in addition to a Parking Charge. However, PCS Ltd reserves the right, in limited circumstances, to pursue recovery of the unpaid parking tariff from the Driver only, where:
• (a) the unpaid tariff is equal to or greater than the amount of the Parking Charge; and
• (b) the Driver has obtained parking services for which no payment, or insufficient payment, was made.
10.4 Any recovery of an unpaid parking tariff under this section:
• is pursued solely against the Driver, and
• does not form part of, or increase, the Parking Charge.
10.5 PCS Ltd will not seek to recover the unpaid parking tariff from the Registered Keeper under Schedule 4 of the Protection of Freedoms Act 2012, and keeper liability shall apply only in respect of the Parking Charge.
10.6 Where PCS Ltd elects to pursue the unpaid parking tariff from the Driver, this may be done:
• separately from the Parking Charge, or
• as an alternative civil claim for the unpaid parking fee,
subject always to applicable law and fairness requirements.
10.7 Under no circumstances will PCS Ltd seek to recover more than:
• the Parking Charge (within the applicable cap), and
• where applicable under this section, the unpaid parking tariff that would have been payable for the Parking Session.
10.8 All such rights apply only where the possibility of tariff recovery has been clearly disclosed on Site Signage, such that the Driver was made aware, before parking, of potential liability for an unpaid parking fee in addition to a Parking Charge under the conditions set out above.
11. Grace and Consideration Periods
11.1 PCS Ltd allows:
• A consideration period upon arrival
• A minimum exit grace period after paid parking ends
11.2 Grace periods are applied in accordance with the Single Code.
11.3 Grace periods do not apply where parking is prohibited.
12. Parking Charge Notices
12.1 PCNs may be issued by:
• Post (ANPR enforcement)
• Notice to Driver
• Hybrid or remote enforcement methods
12.2 PCNs will include:
• Date and time of the breach
• Location
• Reason for issue
• Payment and appeal instructions
13. Keeper Liability (POFA 2012)
13.1 Where the Driver is not identified, PCS Ltd may pursue the Keeper under Schedule 4 of the Protection of Freedoms Act 2012.
13.2 Keeper liability applies only where statutory conditions are met.
13.3 Keepers may transfer liability by providing the Driver’s full details within the prescribed timescale.
14. Appeals and Dispute Resolution
14.1 Appeals must be submitted within the timeframe stated on the PCN.
14.2 Appeals will be assessed fairly and independently.
14.3 If rejected, the appellant will be offered access to an independent appeals service approved under the Single Code.
15. Evidence and Surveillance
15.1 PCS Ltd may use:
• ANPR cameras
• Manual patrols
• Payment logs
• Time stamped images
15.2 Evidence is retained in accordance with data protection law.
16. Data Protection and Privacy
16.1 PCS Ltd processes personal data lawfully and transparently.
16.2 Data may be shared with:
• DVLA
• Appeals services
• Debt recovery agents
• Legal representatives

17. Debt Recovery
17.1 Unpaid Parking Charges may be referred to a debt recovery agent.
17.2 PCS Ltd does not add unlawful or prohibited fees.
17.3 Any additional sums sought will be:
• Court awarded
• Statutorily permitted
18. Legal Proceedings
18.1 PCS Ltd reserves the right to issue proceedings for unpaid Parking Charges.
18.2 Proceedings may be brought against the Driver or Keeper.
18.3 Statutory interest and court costs may be claimed where applicable.
19. Signage Prevails
19.1 Site Signage forms part of the contract.
19.2 Where conflict arises, Signage shall prevail.
20. Liability and Risk
20.1 Vehicles are parked at the Driver’s own risk.
20.2 PCS Ltd accepts no responsibility for:
• Loss or damage to vehicles
• Theft or vandalism
• Personal injury except where caused by negligence
21. Accessibility and Equality
21.1 PCS Ltd complies with the Equality Act 2010.
21.2 Reasonable adjustments will be considered upon request.
22. Amendments
22.1 PCS Ltd may amend these Terms at any time.
22.2 The version in force at the time of parking applies.
23. Severability
23.1 If any provision is found unenforceable, the remaining provisions remain valid.
24. Governing Law
24.1 These Terms are governed by the law of England and Wales.
24.2 The courts of England and Wales have exclusive jurisdiction.
